Terms of Service
Last updated: July 2026
1. Overview
This website and online shop are operated by Zsuzsa Czibere, professionally known as Susan Cibere, trading as The Divine Ginger.
Throughout these Terms of Service, the terms “The Divine Ginger”, “we”, “us” and “our” refer to the operator of this website.
The Divine Ginger offers this website, including all information, content, products, digital materials, appointment bookings, tools and services available through the website, subject to your acceptance of these Terms of Service and all other policies referenced on the website.
Our online shop is hosted by Shopify Inc., which provides the e-commerce platform that allows us to offer and sell our products and services.
By visiting this website, placing an order, downloading digital content, creating an account or booking a service, you agree to be bound by these Terms of Service.
If you do not agree to these Terms, you must not use the website, purchase products or book services through the website.
2. Scope of These Terms
These Terms apply to all users of the website, including visitors, customers, purchasers of physical or digital products, and clients booking online services.
Additional terms may apply to specific products or services. These may include our:
-
Refund and Return Policy
-
Shipping Policy
-
Privacy Policy
-
Appointment Booking Policy
-
Cancellation Policy
-
Withdrawal Information
These policies form part of these Terms of Service where applicable.
Mandatory consumer rights under applicable law remain unaffected.
3. Eligibility and Use of the Website
By using this website or placing an order, you confirm that you have reached the legal age required to enter into a contract in your country of residence.
If you are under the applicable legal age, you may use the website only with the permission and supervision of a parent or legal guardian.
You must not use the website, products, downloads or services for any unlawful, fraudulent or unauthorized purpose.
You must not:
-
introduce viruses, malware or harmful code;
-
attempt to gain unauthorized access to the website or related systems;
-
interfere with the security or functionality of the website;
-
collect personal information about other users without lawful authority;
-
use automated systems to scrape, copy or reproduce website content without permission;
-
infringe our intellectual property rights or the rights of any third party.
We may restrict or terminate access to the website where these Terms are materially violated.
4. Product and Service Information
We make reasonable efforts to ensure that product descriptions, photographs, prices, availability and service information are accurate.
However, minor variations may occur.
Colors displayed on a screen may differ slightly from the appearance of the physical product. Handmade or individually prepared products may also show small natural variations.
Print-on-demand products may differ slightly between individual print runs due to normal production processes.
We reserve the right to correct errors, inaccuracies or omissions and to update product or service information where reasonably necessary.
Nothing in this section limits your statutory rights if a product is defective, incorrectly described or otherwise not in conformity with the contract.
5. Physical Products
Physical products offered through the shop may include books, journals, coloring books and selected Energy Jewelry.
Some physical products are prepared and shipped directly by The Divine Ginger. Other products are produced and fulfilled by third-party printing and fulfillment partners.
The fulfillment method is normally stated on the relevant product page or in our Shipping Policy.
Products from different fulfillment locations may arrive in separate packages.
Delivery times are estimates and may be affected by production schedules, carrier delays, customs processing, public holidays, weather conditions or other circumstances outside our reasonable control.
6. Print-on-Demand Books and Journals
Books, journals and selected printed products may be produced individually after an order is placed through a print-on-demand process.
These products may be printed and shipped directly by our fulfillment partner, including Lulu.
Print-on-demand production may begin shortly after an order is confirmed. Changes to the order, product, quantity or delivery address may no longer be possible once production has begun.
Standard print-on-demand products are not automatically classified as personalized products solely because they are printed after the order is placed.
Return and withdrawal rights are governed by our Refund and Return Policy and applicable consumer law.
Products must not be returned directly to a printing or fulfillment partner unless you have received explicit return instructions from us.
7. Digital Products
Digital products may include downloadable books, journals, worksheets, coloring pages, meditation recordings, audio files, written materials, courses or other digital content.
Digital products are normally delivered electronically through a download link, customer account, email or another digital delivery method.
You are responsible for ensuring that your device, software and internet connection are suitable for accessing the purchased content.
Unless expressly stated otherwise, the purchase of a digital product grants you a limited, personal, non-exclusive and non-transferable licence to use the product for your own private purposes.
You may not:
-
resell or redistribute the digital product;
-
share the files with other persons;
-
upload the files to file-sharing platforms or public websites;
-
reproduce the product for commercial distribution;
-
use the content in another product offered for sale;
-
remove copyright notices or ownership information;
-
claim the content, illustrations, designs, recordings or written material as your own.
Digital coloring pages may be printed for personal use and may be imported into compatible digital coloring or note-taking applications for personal use.
No ownership rights or intellectual property rights are transferred to you.
8. Digital Delivery and Technical Issues
Digital delivery may begin immediately after payment or order confirmation.
Where legally required, you may be asked to expressly consent to immediate digital delivery and acknowledge that your statutory withdrawal right may expire once delivery or download begins.
You are responsible for entering a correct email address and for downloading and securely storing your purchased files.
If you receive an incorrect file, a corrupted file or experience a genuine technical problem, please contact us at info@thedivineginger.com.
We will make reasonable efforts to provide access to the correctly purchased digital content.
We cannot guarantee permanent access to download links, third-party platforms or customer accounts. Customers should download and securely store their files after purchase.
9. Appointment Bookings and Online Services
Online services may include Reiki distance sessions, online coaching, live meditations, courses and other scheduled services.
The exact scope, duration, format and content of each service are described on the relevant product or booking page.
You are responsible for:
-
selecting the correct service and appointment time;
-
providing accurate contact information;
-
checking the time zone shown during booking;
-
ensuring that you have a suitable internet connection and compatible device;
-
joining the appointment on time;
-
providing a quiet and appropriate environment where necessary.
Appointment changes and cancellations are governed by the Appointment Booking Policy contained in our Refund and Return Policy.
You may reschedule an appointment through the booking system up to 3 hours before the scheduled start time.
Appointments that need to be rescheduled less than 3 hours before the scheduled start time are considered firmly booked.
Appointments may be cancelled through the booking system up to 24 hours before the scheduled start time.
Appointments cancelled less than 24 hours before the scheduled start time, as well as appointments that are not attended, are non-refundable, subject to any mandatory statutory rights.
10. Nature of Reiki, Energy Work and Self-Development Services
Reiki, energy work, meditation, coaching, journaling and self-development services are intended to support relaxation, self-reflection, energetic balance, emotional awareness and personal development.
They are not medical, psychiatric, psychological or psychotherapeutic treatment and do not replace diagnosis, treatment or advice from a qualified healthcare professional.
No specific medical, emotional, financial, professional or personal result is promised or guaranteed.
Individual experiences and results may vary.
You remain responsible for your own decisions, wellbeing, actions and use of the information or practices provided.
If you have a medical or psychological condition, are receiving treatment, are pregnant, or are unsure whether a service is suitable for you, you should seek appropriate professional advice before participating.
In urgent medical or psychological situations, contact the appropriate emergency or healthcare service in your country.
11. Courses, Meditations and Educational Content
Courses, workshops, meditations, exercises, prompts, articles and other educational materials are provided for general informational and self-development purposes.
They must not be interpreted as individualized medical, psychological, legal, tax, investment or financial advice.
Participation does not create a therapist-patient, doctor-patient, legal adviser-client or financial adviser-client relationship.
You are responsible for deciding whether and how to apply the information provided.
12. Prices and Payment
Prices are displayed in the currency available for your selected market or checkout.
Prices may be changed at any time before an order is placed.
The price applicable to your order is the price displayed at checkout when the order is submitted.
Unless otherwise indicated, applicable taxes may be calculated and displayed during checkout.
International customers may be responsible for customs duties, import taxes, VAT, handling fees or other charges imposed by the destination country.
Payment must be completed using one of the payment methods available during checkout.
Your order is not accepted until payment has been successfully authorized and you receive an order confirmation, unless otherwise stated.
13. Orders and Contract Formation
Submitting an order constitutes an offer to purchase the selected products or services.
An automated order confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance where further verification is required.
We may refuse or cancel an order for legitimate reasons, including:
-
incorrect pricing or product information;
-
payment failure or suspected fraud;
-
lack of product availability;
-
technical errors;
-
delivery restrictions;
-
suspected unauthorized resale;
-
violation of these Terms.
If an order is cancelled after payment has been received, the relevant amount will be refunded unless the customer is legally responsible for a charge already incurred.
14. Billing and Account Information
You agree to provide current, complete and accurate billing, delivery, account and contact information.
You are responsible for checking that your email address, shipping address and other order details are correct before submitting an order.
We are not responsible for delays, failed delivery or additional costs caused by incorrect information supplied by the customer, except where applicable law provides otherwise.
You are responsible for maintaining the confidentiality of your customer account and password.
Please notify us promptly if you suspect unauthorized use of your account.
15. Shipping and Delivery
Shipping destinations, estimated delivery periods and relevant shipping conditions are described in our Shipping Policy and during checkout.
Books, journals and Energy Jewelry may be fulfilled from different locations and may arrive in separate packages.
Risk of loss or damage passes in accordance with applicable consumer law.
Where consumer law applies, nothing in these Terms transfers the risk to the customer before the goods have been received by the customer or a person designated by the customer, except where the customer independently commissions a carrier not offered by us.
16. Returns, Refunds and Withdrawal Rights
Returns, refunds, cancellations and statutory withdrawal rights are governed by our Refund and Return Policy and any applicable Withdrawal Information.
Customers in the European Union or European Economic Area may have a statutory right to withdraw from eligible online contracts within 14 days.
Certain statutory exceptions may apply, including to:
-
clearly personalized or custom-made products;
-
unsealed products that cannot be returned for health or hygiene reasons;
-
fully performed services where the legally required consent and acknowledgement were provided;
-
digital content where delivery began after the legally required consent and acknowledgement were provided.
Mandatory statutory rights concerning defective or non-conforming goods, digital content and services remain unaffected.
17. Gift Cards and Vouchers
Gift cards and vouchers may be used only in accordance with the conditions stated at the time of purchase.
They cannot normally be exchanged for cash or refunded, except where required by law.
Gift cards and vouchers must not be resold without written permission.
The customer is responsible for protecting gift card codes from unauthorized access.
18. Intellectual Property
Unless otherwise stated, all content on this website is owned by or licensed to The Divine Ginger and Susan Cibere.
This includes:
-
illustrations;
-
mandala designs;
-
book and journal interiors;
-
photographs;
-
graphics;
-
logos;
-
product names;
-
written content;
-
meditation recordings;
-
audio content;
-
worksheets;
-
courses;
-
downloadable files;
-
website design and layout.
The content is protected by applicable copyright, trademark and intellectual property laws.
You may view and use the website for personal, non-commercial purposes.
You may not copy, reproduce, modify, publish, distribute, sell, license, transmit or commercially exploit any website or product content without prior written permission.
19. Reviews, Feedback and User Content
If you voluntarily submit a review, testimonial, image, comment or other content, you confirm that:
-
you have the right to submit it;
-
it is accurate to the best of your knowledge;
-
it does not violate the rights of another person;
-
it is not unlawful, abusive, misleading or defamatory;
-
it does not contain malware or harmful code.
Where you provide permission for publication, you grant us a non-exclusive right to display, reproduce and use the submitted content for the stated purpose.
We will not materially alter a testimonial in a way that misrepresents your experience.
We may remove content that violates these Terms or applicable law.
20. Third-Party Services and Links
The website may use or link to third-party services, including Shopify, payment providers, booking systems, video-conferencing services, digital delivery platforms, printing partners and shipping providers.
Third-party services are governed by their own terms and privacy practices.
We are not responsible for the content or operation of independent third-party websites.
However, this does not exclude responsibility that cannot lawfully be excluded, including responsibility for our selection or use of service providers where applicable.
21. Availability of the Website and Services
We aim to keep the website and services reasonably available but cannot guarantee uninterrupted or error-free access.
Access may occasionally be restricted because of maintenance, technical problems, platform outages, security concerns or circumstances beyond our reasonable control.
We may update, modify or discontinue website features, products or services where reasonably necessary.
Existing customer rights and confirmed contractual obligations remain unaffected.
22. Disclaimer and Limitation of Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
In particular, we do not exclude liability for:
-
death or personal injury caused by intent or negligence;
-
fraud or fraudulent misrepresentation;
-
intentional misconduct or gross negligence;
-
liability under mandatory product liability law;
-
breaches of mandatory consumer rights.
For ordinary negligence, we are liable only where an essential contractual obligation has been breached. In such cases, liability is limited to the type of damage that was reasonably foreseeable when the contract was concluded, to the extent permitted by law.
Essential contractual obligations are obligations whose proper performance is necessary for the contract to be fulfilled and on whose performance the customer may normally rely.
Mandatory statutory warranty, conformity and consumer protection rights remain unaffected.
23. Indemnity for Unlawful Use
To the extent permitted by applicable law, users acting in a commercial or professional capacity agree to compensate us for reasonable losses and expenses arising directly from their unlawful use of the website or intentional infringement of our intellectual property rights.
This section does not impose an unreasonable indemnity obligation on consumers and does not limit mandatory consumer rights.
24. Privacy and Data Protection
The processing of personal information is governed by our Privacy Policy.
Personal data may be processed by service providers required to operate the shop, process payments, deliver products, provide downloads, manage bookings or conduct online appointments.
Please review our Privacy Policy for further information about the categories of data processed, the purposes of processing and your rights.
25. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.
The invalid provision will be replaced, where legally possible, by a valid provision that most closely reflects its original commercial purpose.
26. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we waive the right to enforce it later.
27. Governing Law and Consumer Protection
These Terms and contracts concluded through this website are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods.
If you are a consumer residing outside Germany, this choice of law does not deprive you of any mandatory consumer protection rights available under the law of your country of habitual residence.
Any mandatory rules concerning jurisdiction remain unaffected.
28. Changes to These Terms
We may update these Terms where reasonably necessary, including because of changes to our products, services, technology, business operations or applicable law.
The current version will be published on this page together with the date of the latest update.
Changes do not retroactively alter orders or contracts already concluded unless required by law or expressly agreed with the customer.
